Common use of Warranty by the Executive Clause in Contracts

Warranty by the Executive. The Executive represents and warrants to Holdings and the Company that he is not a party to any agreement containing a noncompetition provision or other restriction with respect to (i) the nature of any services or business which he is entitled to perform or conduct for Holdings or the Company under this Agreement, or (ii) the disclosure or use of any information which directly or indirectly relates to the nature of the business of Holdings or any of its Subsidiaries or the services to be rendered by the Executive under this Agreement.

Warranty by the Executive. The Executive represents and warrants to Holdings and the Company that he she is not a party to any agreement containing a noncompetition provision or other restriction with respect to (i) the nature of any services or business which he she is entitled to perform or conduct for Holdings or the Company under this Agreement, or (ii) the disclosure or use of any information which directly or indirectly relates to the nature of the business of Holdings the Company or any of its Subsidiaries or the services to be rendered by the Executive under this Agreement.

The Executive represents and warrants to Holdings and Holdings, the Company and CFI that he is not a party to any agreement containing a noncompetition provision or other restriction with respect to (i) the nature of any services or business which he is entitled to perform or conduct for Holdings or Holdings, the Company or CFI under this Agreement, or (ii) the disclosure or use of any information which directly or indirectly relates to the nature of the business of Holdings or any of its Subsidiaries or the services to be rendered by the Executive under this Agreement.
