WARRANTY GUARANTY. To secure the Developer’s performance of the warranty under Section 3.08, the performance guaranty provided by the Developer under section 2.02 shall remain in effect until the end of the warranty period, or the Developer shall provide a warranty guaranty by one or more of the methods described in Sections 2.03 through 2.05, determined by the following table: Actual Cost of All Improvements Percent to Secure Warranty Less than $500,000.00 10.0% $500,000.00 - $1,000,000.00 7.5% Over $1,000,000.00 5.0%
