Notwithstanding anything to the contrary herein, in the event Customer fails or refuses to sign the Installation Completion Acknowledgement Form and SONIFI, in its sole but reasonable discretion, determines that it has completed all of its Internet Access Equipment installation and activation obligations under the Broadband Agreement, the Installation Completion Acknowledgement Form shall be deemed to have been accepted and signed by Customer “as-is” as of the date of SONIFI notifies Customer of XXXXXX’s determination.
