Where Tenant is at Fault. If any damage or destruction by fire or other cause to the Building or Premises, whether partial or not, is due to the fault or neglect of Tenant, its officers, agents, employees, servants, visitors or licensees, without prejudice to any other rights and remedies of Landlord and without prejudice to the rights of subrogation of Landlord’s insurer: (1) Tenant shall be liable for all costs and damages, (2) the damages may be repaired by Landlord at Tenant’s expense, (3) Tenant shall forfeit its right to terminate this lease as provided in Article 12.1(1), (4) Tenant shall forfeit any abatement of rent provided in this Article 12 and rent shall not xxxxx.
