Common use of Where the Account Holder Clause in Contracts

Where the Account Holder. is a Consumer or a Micro- enterprise, in the event that the User and/or the Account Holder denies having authorized the Payment Transaction or he disputes the correct execution of the Payment Transaction, the Bank shall bear the burden of proving that the Payment Transaction was authenticated, accurately recorded, entered in the Account Holder’s Account and not affected by a technical breakdown or deficiency. Where the Account Holder is neither a Consumer nor a Micro-enterprise, the Bank shall not bear such burden of proof.
