Where the Customer. (a) terminates (in whole or in part) this Call Off Contract under any of the Clauses referred to in Clause 45.1; and
Where the Customer. 34.1.1 terminates (in whole or in part) this Contract under any of Clauses 30.1, 30.2, 30.3 and 30.11; and
Where the Customer. 6.1 receives the Bronze Package (as indicated in a Work Order), the Support Services will be made available to the Customer's Representative from 09:00-17:30 on Business Days;
Where the Customer a. receives additional Credit as a result of the Upgrade; or
Where the Customer accepts the terms of an End-User Licensed Software, the license shall exclusively comprise the Customer’s rights and remedies in respect of such End-User Licensed Software. The Agreement shall not take precedence.
Where the Customer has been notified of a Security Breach, the Supplier shall comply with its obligations under and the Customer may exercise any of its rights under schedule 4 of this Agreement (Action Plan Process).
Where the Customer has proposed a contract change and the Supplier is unable to provide the change, including where the Parties are unable to agree a change to the Contract Charges, the Customer may terminate this Contract with immediate effect.
Where the Customer is a member of a federation or larger group, as part of this arrangement, such group may be entitled to obtain data insights. Where this is the case GWD will seek the Customer’s consent to participate in such sharing of data insights.
Where the Customer is in or subject to a jurisdiction with any secrecy laws, the Customers confirms that it waives the benefit of all such secrecy laws in relation to the terms of this Agreement, including, without limitation, any enquiry by any Hong Kong regulator contemplated in this Clause 21, to the fullest extent permitted by the laws of such jurisdiction.
Where the Customer s request for additional capacity on a connection facility under section J.4.3 triggers the implementation of the Transmitter’s Board-approved available capacity procedure referred to in section 6.2.11 of the Code, any assignment of available capacity to the Customer shall be determined in accordance with that procedure or, in the absence of such Board-approved procedure, in accordance with section 6.1.8 of the Code.
