WILL SERVE LETTERS. LAST TRANCHE - The twenty five (25) will serve letters of the Last Tranche as identified in Section 11 (d) of Amendment 1 shall be released only upon the last of the following to occur: (a) the City of Manteca’s final approval of the location of the Pig Retrieval Station that is acceptable to the District, or
WILL SERVE LETTERS. Borrower shall, at Lender’s request, (x) obtain and deliver to Lender, in a form reasonably satisfactory to Lender, “will-serve” letters from each general contractor and (y) use commercially reasonable efforts to obtain and deliver to Lender, in a form reasonably satisfactory to Lender, “will-serve” letters for all contracts related to the CapEx, including contracts with each architect, engineer and construction manager performing work at the Property, in each case, to the extent such contract is an amount in excess of $200,000.
