Common use of Withdrawals Limited to Available Deposits Clause in Contracts

Withdrawals Limited to Available Deposits. Anything herein to the contrary notwithstanding, the Company shall not have the right, and shall not be entitled, at any time to request the issuance of Series AA Equipment Notes, Series A Equipment Notes, Series B Equipment Notes or Series C Equipment Notes in respect of the Pre-Funded Aircraft to the Class AA Pass Through Trustee, Class A Pass Through Trustee, Class B Pass Through Trustee or the Class C Pass Through Trustee, respectively, in an aggregate principal amount in excess of the amount of the Deposits then available for withdrawal by the Escrow Agent under and in accordance with the provisions of the applicable Deposit Agreement.
