Common use of Withholding for Failure to Perform Clause in Contracts

Withholding for Failure to Perform. The Department may withhold payment at any time during the term of the Contract and may withhold final payments under the Contract if the Contractor is failing to perform its duties and responsibilities in accordance with the terms of this Contract. The Department will give the Contractor written notice of both the amount of withheld and of the basis for the withholding of payment.
