Common use of Without Consent of Holder Clause in Contracts

Without Consent of Holder. In addition to the provisions of Section 9.01 of the Base Indenture, the Issuers and the Trustee may, as applicable, amend or supplement this Tenth Supplemental Indenture, the Note Guarantees or the 2036 Notes, without the consent of any Holder of a 2036 Note to: (a) convey, transfer, assign, mortgage or pledge as security for the 2036 Notes any property or assets in accordance with Section 5.01 of this Tenth Supplemental Indenture and confirm or evidence any release thereof permitted by the Indenture.

Without Consent of Holder. In addition to the provisions of Section 9.01 of the Base Indenture, the Issuers Issuer, the 2024 Note Guarantors and the Trustee may, as applicable, amend or supplement this Tenth Second Supplemental Indenture, the Note Guarantees of the 2024 Notes or the 2036 2024 Notes, without the consent of any Holder of a 2036 2024 Note to: (a) convey, transfer, assign, mortgage or pledge as security for the 2036 2024 Notes any property or assets in accordance with Section 5.01 of this Tenth Second Supplemental Indenture and confirm or evidence any release thereof permitted by the Indenture.
