Wrap and Similar Programs Clause Samples
The "Wrap and Similar Programs" clause defines how the agreement applies to software or services that are distributed under so-called "wrap" licenses, such as clickwrap, shrinkwrap, or browsewrap agreements. This clause typically clarifies that the terms of the main agreement will govern the use of such programs, even if the software itself presents additional terms upon installation or access. By doing so, it ensures that the parties are not inadvertently bound by conflicting or supplementary terms presented by third-party software, thereby maintaining consistency and reducing the risk of unexpected obligations.
Wrap and Similar Programs. If you intend to offer and sell the Funds’ shares through a wrap or similar managed account, you shall be subject to a separate supplement with us regarding the treatment of such account, which shall be incorporated by reference into and considered a part of this Agreement.
