Xx Claim Preclusion. Nothing in this Section 8 shall be construed to preclude any Party from making any claim against any other Party arising out of a failure to perform obligations under this Agreement. No Party shall be precluded from claiming or commencing an action for contribution to any amounts the other may be required or otherwise agree to pay to an Investor or other third party, including a regulator, with jurisdiction over the Services.
