If at any time, the Applicant has reason to believe that it no longer satisfies such criteria, or may be unable to satisfy such criteria, it shall notify the EPC immediately of the circumstances. The Applicant is in a position to comply with all of the obligations set out in the Rulebook by the Readiness Date as stated in the accompanying Schedule. By submitting this completed form of Adherence Agreement the Applicant agrees to be bound by the provisions of the EPC Payment Scheme Management Rules governing applications for participation in the Scheme, whether or not it becomes a Participant. The Applicant Terms and Conditions of Contract shall apply to each purchase order and the Services to be provided thereunder, save that in the event that a purchase order is not placed by the Commissioner but instead by the Other Contracting Body, all references in the Terms and Conditions of Contract to the ”Commissioner” shall, in relation to such purchase order, be deemed to be a position reference to the police and crime commissioner of the Other Contracting Body and all references to the “Chief Constable”, “Force” and/or “SWP” shall be deemed to be a reference to the Chief Constable, Force and/or DPP for the time being of such Other Contracting Body. The Contractor accepts and acknowledges that the Commissioner shall not be liable to the Contractor for any costs and/or expenses which are incurred by the Contractor in respect of the provision of the Service to any Other Contracting Body howsoever arising, including, but not limited to, as a result of a failure by any Other Contacting Body to whom the Services are supplied to comply with all any relevant obligation of the obligations Contractor. The Contractor accepts and agrees that liability for any default or performance, whether in respect of payment of otherwise, shall rest with the Other Contracting Body named on the purchase order, and not with the Commissioner.
