Common use of XXXXXX AND REMEDIES Clause in Contracts

XXXXXX AND REMEDIES. No delay or omission by Buyer or Supplier in exercising the right or power it has pursuant to the terms of the Agreement shall impair or be construed as a waiver of such right or power. No waiver of any breach of any provision of the Agreement shall constitute a waiver of any other breach of such or any other provision. Remedies available to Buyer or Supplier in relation to the Agreement shall be cumulative and additional to any other or further remedies implied or available at law, in equity or contained in these terms and conditions.
