Common use of Xxxxxxxx Fresh German Group Clause in Contracts

Xxxxxxxx Fresh German Group. (a) CBI shall not permit the aggregate amount of cash and Cash Equivalents owned or maintained by Persons which are members of the Xxxxxxxx Fresh German Group to exceed $15,000,000 at any time; provided, however, that for purposes of this Section 8.6(a) only, the amount of “cash” shall be determined net of bank overdrafts incurred by the Xxxxxxxx Fresh German Group in the ordinary course of business.

Xxxxxxxx Fresh German Group.
