Common use of Xxxxxxxx-Xxxxx Act Compliance Clause in Contracts

Xxxxxxxx-Xxxxx Act Compliance. There is and has been no failure on the part of the Company and any of the Company’s directors or officers, in their capacities as such, to comply with any provision of the Xxxxxxxx-Xxxxx Act of 2002 and the rules and regulations promulgated in connection therewith (the “Xxxxxxxx-Xxxxx Act”), to the extent applicable to the Company, including Section 402 relating to loans.

Xxxxxxxx-Xxxxx Act Compliance. There is and has been no failure on the part of the Company and or any of the Company’s directors or officers, in their capacities as such, to comply with any provision of the Xxxxxxxx-Xxxxx Act of 2002 and the rules and regulations promulgated in connection therewith (the “Xxxxxxxx-Xxxxx Act”), to the extent applicable to the Company, including without limitation Section 402 relating related to loansloans and Sections 302 and 906 related to certifications.

Xxxxxxxx-Xxxxx Act Compliance. There is and has been no failure on the part of the Company and or any of the Company’s directors or officers, in their capacities as such, to comply with any provision with, and on the Effective Date the Company will be in compliance with, the provisions of the Xxxxxxxx-Xxxxx Act of 2002 and the rules and regulations promulgated in connection therewith (the “Xxxxxxxx-Xxxxx Act”), to the extent applicable to the Companyincluding, including without limitation, Section 402 relating related to loans.

There is and has been no failure on the part of the Company and or, to the knowledge of the Company, any of the Company’s directors or officers, in their capacities as such, to comply with any provision of the Xxxxxxxx-Xxxxx Act of 2002 2002, as amended and the rules and regulations promulgated in connection therewith (the “Xxxxxxxx-Xxxxx Act”), to the extent applicable to the Companytherewith, including Section 402 relating related to loansloans and Sections 302 and 906 related to certifications.
