Common use of Your Duties Clause in Contracts

Your Duties. You must pay for and replace batteries as needed, unless the law provides otherwise. We may re- place dead or missing batteries at your expense, with- out prior notice to you. You must immediately report alarm or detector malfunctions to us. Neither you nor others may disable alarms or detectors. If you dam- age or disable the smoke alarm, or remove a bat- tery without replacing it with a working battery, you may be liable to us under Texas Property Code sec. 92.2611 for $100 plus one month’s rent, actual dam- ages, and attorney’s fees. You’ll be liable to us and others if you fail to report malfunctions, or fail to report any loss, damage, or fines resulting from fire, smoke, or water.
