For a sole proprietor, doing business as or single owner account, you understand that it is your sole responsibility and not our re- sponsibility to assure that the ownership and survivorship features of your accounts and services, as designated by you in Part 1 of this Contract (the account form), accurately reflect and take into consideration your personal, domestic, business and estate plan- ning needs (such as, but not limited to, those created, changed or terminated by marriage, children, adoption, separation, divorce, remarriage, death or as a result of any agency, guardianship, conservatorship, trusts, xxxxx, incorporations, partnership agree- ments, contracts, indebtedness, etc.). If permitted by applicable state law, you irrevocably waive your rights to make testamentary dispositions from any account, and do so with the understanding that authorized person designations and if applicable the owner- ship and survivorship features of an account (such as “multi- ple/joint account ownership with right of survivorship” and “benefi- ciary/POD payee” designations) control and supersede any inconsistent testamentary disposition. Because it is your respon- sibility to assure that authorized person designations and if appli- cable the ownership and survivorship features of your account(s) and services accurately reflect and take into consideration your personal, domestic, business and estate planning needs, and be- cause you can change, add or close or terminate an account or service at any time, you irrevocably waive your right to make a testamentary disposition from any account at the Credit Union, both now and in the future. Also, because you are in complete control of authorized person designations and if applicable the ownership and survivorship features of your account(s) and ser- vices, and can change, add, close or terminate the account(s) and services at any time, and have agreed that we may rely ex- clusively on the terms of Parts 1 and 2 of this Contract, upon your death we may rely exclusively on the terms of Parts 1 and 2 of this Contract concerning all matters that affect your account(s) and services.
