Common use of YOUR RIGHTS AND LIABILITY Clause in Contracts

YOUR RIGHTS AND LIABILITY. Tell us AT ONCE if you believe your Card and/or Personal Identification Number (“PIN”) has been lost or stolen, or if you believe that an electronic fund transfer has been made without your permission using information from your check. Contact us via the telephone number listed in this disclosure or via Online Banking to mitigate any potential losses. Telephoning is the best way of keeping your possible losses down. You could lose all the money in your account, plus your maximum overdraft line of credit or the balance in any other account connected to your account for overdraft protection. If you tell us within two (2) Business Days after you learn of the loss or theft of your Card and/or PIN, you can lose no more than $50 if someone used your Card and/or PIN without your permission. You will not be liable for subsequent unauthorized transfers after notification. If you do NOT tell us within the first two (2) Business Days after you learn of the loss or theft of your Card and/or PIN, and we can prove we could have stopped someone from using your Card and/or PIN without your permission if you had told us, you could lose as much as $500. Also, if your statement shows transfers that you did not make, including those made by Card, PIN, or other means, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. If extenuating circumstances (such as an extended trip or hospitalization) kept you from telling us, we may extend the time periods at our discretion. You agree to keep your Card and PIN in a place of safekeeping, to refrain from disclosing your PIN to any unauthorized third party, to refrain from writing your PIN on your Card, and to refrain from recording or displaying your PIN in such a manner that it will be accessible by unauthorized third parties. If you give your Card or PIN to someone else, you are responsible for all transfers or purchases that that person makes with your Card or via the service that he or she accesses, even if that person uses the Card or PIN in a way that you did not anticipate or intend. You are responsible for reporting the loss or theft of your Card or PIN to us as soon as possible after the loss or theft.
