20th Addendum
to Lease Agreement No. 01/2003
from 12/01/2002
BioCentiv GmbH (Lessor)
and 4-Antibody AG (Lessee)
amend the above-mentioned Lease Agreement on the basis of the application of BioCentiv GmbH to the State Administration Office of Thuringia from 09/08/2010 (Annex 1 to this Addendum) and its approval from 10/05/2010 (Annex 2 to this Addendum) as follows:
Section 3 Term of lease, termination
The lease term is extended by three years until 02/28/2014.
The Lessee is granted the option of extending the lease for another two years. The Lessee must decide about exercising this option at least nine months before the expiry of the lease (05/31/2013).
A termination notice period of 12 months is agreed upon for the term of the lease.
The Lessor has the right to terminate the lease according to the contract, especially when other small and medium-sized companies express the need to use spaces in the BioInstrumentezentrum, and such need cannot be fulfilled otherwise. Such need must be demonstrated to the Lessee.
Section 4 Rent, other payments
The basis for the calculation of the rent starting from 03/01/2011 is the expert opinion of the Expert Office of Xxxxxx Xxxxxx, Bad Langensalza, from 07/02/2008 (Annex 3 to this Agreement).
