This Brownfields Development Agreement (“Agreement” or “BDA”) regarding the Electric Hose and Rubber Site (DE-0174) (“the Site”) is made and entered into pursuant to the Delaware Hazardous Substance Cleanup Act (“HSCA”), 7 Del. C. Chapter 91, by and between the Department of Natural Resources and Environmental Control ("DNREC") and Brandywine Realty LLC ("Brownfields Developer"), 925 Market Street, Paterson, NJ 07513, a limited liability company organized under the laws of Delaware (collectively referred to as “the Parties”). The real property that is the subject of this Agreement is located at 1340, 1318 and 1400 East 12th Street and is further identified as New Castle County tax parcel numbers 26-045.00-018 and 26-045.00- 006.
