Contract Type FiledSeptember 4th, 2021The Dutch civil code describes as a security agreement in which a third party is committed to a contractual creditor to perform the contractual obligations of a debtor. This security agreement is stipulated between the guarantee and the creditor. The debtor of the guaranteed obligation is not required to be part of such an agreement. It is also conceivable that such a guarantee agreement is stipulated without the knowledge or consent of the debtor. Article 7: 850 of the Dutch Civil Code states the following: 1. A surgeon agreement is an agreement based on which one of the parties ('the guarantee') is committed to the other party ('creditor') To perform an obligation that a third party ('the main debtor') is or will be due to the creditor. 2. For the validity of the guarantee contract it is not necessary that the main debtor is aware of the existence of the bail involved. 3. The provisions of law for solidarity bonds apply to a guarantee contract, as regards the provisions of this Title
