Whereas, the Kentucky Energy and Environment Cabinet, an agency of the Commonwealth of Kentucky, has established certain regulations applicable to the Grantor, requiring that an owner or operator of a hazardous waste site or facility or group of facilities must demonstrate financial responsibility for bodily injury and property damage to third parties caused by sudden accidental and/or nonsudden accidental occurrences arising from operations of the facility or group of facilities.
