THIS AMENDED AND RESTATED EMPLOYEE CONFIDENTIALITY AND NON-COMPETITION AGREEMENT is made as of May 11, 2015, by the undersigned employee (hereinafter called “Employee”) of American Realty Capital Properties, Inc.
