These Terms and Conditions of Service (the “Terms”) shall apply and be deemed incorporated into each purchase order referencing these Terms (each, an “Order”) that is executed in writing by Electric Avenue Software, Inc. (“Optify”) and the client executing the Order that references these Terms. Optify’s acceptance of the Order is expressly conditioned upon Client’s assent to these Terms. These Terms, collectively with the Order executed by the parties, are hereafter collectively referred to as the “Agreement”.
