THIS AGREEMENT (“Agreement”) is made and entered into on the last date set forth on the signature pages below (“Effective Date”), by and between Dr. Andrew J. Severson including all successors in interest, subsequent purchasers from Dr. Severson and assigns collectively (“Dr. Severson”), and the City of Rapid City (“the City”). Collectively, Dr. Severson and the City shall be referred to as the “Parties.” The purpose of this Agreement is to clarify, modify and resolve any and all disputes regarding the “1993 Agreement” entered into by the parties dated August 9, 1993, and this Agreement shall control if there is a conflict.
