Customer is a “Covered Entity” that is required to meet the requirements of Title II of the Health Insurance Portability and Accountability Act of 1996, Pub. L. No. 104-‐91, Part I of Title XIII of the American Recovery and Reinvestment Act of 2009, Pub. L. No. 111-‐5 (“the HITECH Act”) and implementing regulations enacted by the Department of Health and Human Services at 45 CFR Parts 160 -‐ 164. This includes 45 CFR Part 164 Subpart C – Security Standards for the Protection of Electronic Protected Health Information (“the Security Rule”), Subpart D – Notification in the Case of Breach of Unsecured Protected Health Information (“the Breach Notification Rule”), and Subpart E – Privacy of Individually Identifiable Health Information (“the Privacy Rule”). (The foregoing laws and rules are sometimes collectively referred to hereaZer as “HIPAA”.)
