A Consultancy Agreement is a non-regulated type of agreement that leaves considerable freedom to the parties to agree on the terms as they see fit. Although a self-employed consultant can be either a natural person or a legal entity, it is generally recommended to enlist the services of a company in order to decrease the risk of re-characterisation by the social security administration and the labour courts of an individual consultant’s relationship with the employer as an employment contract (this risk is omnipresent and requires careful monitoring for the duration of the relationship). A Consultancy Agreement can be of either indefinite or definite duration. However, under the general rules of contract law, the parties generally have more leeway with respect to termination and notice if the agreement is concluded for an indefinite duration.
