This SaaS TERMS OF SERVICE LICENESE AGREEMENT, together with any Order Form, (this “Agreement”) between INSTANA, Inc., a Delaware corporation, with its principle place of business at 222 Merchandise Mart Plaza, Suite 1212, Chicago, IL 60654 (“Instana”) and you or the end user referenced in the Order Form (as defined below) (“Client”) is effective the earlier of the date the initial Order Form is executed or you first use the Service (the “Effective Date”).
