This Data Processing Agreement (“DPA”) is made and entered into as of the date of the last signature below and forms part of the applicable services or license agreement (the “Agreement”) entered by and between Applicaster Ltd./Inc./UK LTD, (“Applicaster”, “Us”, “We”, “Our”, “Service Provider” or “Data Processor”) and You (as defined below). You acknowledge that you, on behalf of [ ] incorporated under [ ] law, with its principal offices located at [ ] (“Organization”) (collectively, “You”, "Your”, “Customer”, or “Data Controller”) have read and understood and agree to comply with this DPA, and are entering into a binding legal agreement with Applicaster to reflect the parties’ agreement with regard to the Processing of Personal Data (as such terms are defined below) of European individuals. Both parties shall be referred to as the “Parties” and each, a “Party”.
