This ENERGY STORAGE AGREEMENT (“Agreement”) is made and entered into as of [ ], 2024 (the “Effective Date”) by and between the Incorporated County of Los Alamos, New Mexico, a political subdivision and home-rule county organized and existing under the laws of the State of New Mexico (“Buyer”) and Foxtail Flats Storage, LLC, a Delaware limited liability company (“Seller”). Buyer and Seller are referred to herein individually as a “Party” and collectively the “Parties”.
