This Indefinite Delivery Indefinite Quantity Amendment No. 3 to Assignment No. 1 (hereinafter referred to as “Amendment No. 3 to Assignment No. 1”) is entered into by and between the Texas Facilities Commission (hereinafter referred to as “TFC”), a state agency located at 1711 San Jacinto Boulevard, Austin, Texas 78701 and Lockwood, Andrews & Newnam, Inc., located at 8911 North Capitol of Texas Highway, Building 2, Suite 2300, Austin, Texas 78759 (hereinafter referred to as “PSP”) (hereinafter collectively referred to as the “Parties”) to be effective on the Effective Date (as defines below) and to be subject to the terms and conditions of TFC Contract No. 18-039-000, its Assignment No. 1, as amended, and those that follow.
