The Texas Facilities Commission (hereinafter referred to as “TFC”), a state agency located at 1711 San Jacinto Boulevard, Austin, Texas 78701, as Owner (as defined in 2015 Uniform General Conditions, Section 1.28) and HMG & Associates, Inc. (hereinafter referred to as “PE,” or for purposes of UGC definition, as “Architect/Engineer,” and “Contractor”), located at 12515 Research Boulevard, Suite 7-140, Austin, Texas 78759, enter into the following agreement for Professional Mechanical Electrical and Plumbing Engineering and Other Related Professional and Technical Services Agreement (hereinafter referred to as the “Agreement”) pursuant to the Professional Services Procurement Act, Tex. Gov’t Code Ann. Ch. 2254, Subchapter. A, to be effective as of the Effective Date (as defined below).
