Marriage agreements are usually made before or when the marriage takes place as contained in Law Number 16 of 2019 Article 29. However, with the issuance of the Constitutional Court decision No. 69/PUU-XIII/2015 then followed by Regulation of the Minister of Religion of the Republic of Indonesia Number 19 of 2018 Concerning Marriage Registration, that it is not permissible to make a marriage agreement after a marriage has taken place which is contrary to the 1945/unconstitutional Law, so the author feels it is very necessary to a study of the arguments in the decisions of the Constitutional Court and the PMA and what legal consequences arise from these changes. In this paper the author uses a juridical approach.
