AGREEMENT TO IDENTIFY:June 14th, 2023
Facility/Equipment user shall indemnify the Wahluke School District, from and against any and all claims, demands, causes of action, suits or judgments including but not limited to, any claims of insurance carriers, the Department of Labor and Industries, the Department of Social and Health Services, and any federal agency, healthcare provider or governmental, taxation agency, (including costs and expenses incurred in connection therewith), for death or injuries to persons or for loss of damage to property arising out of or in connection with the use and occupancy of the Facility by the user, its agents, servant, employees or invitees whether or not caused by the Wahluke School District’s negligence: Specifically, this contract of indemnity should be constructed to mean the user will indemnify the Wahluke School District against losses resulting from the negligence of the user.
