THIS DEVELOPER'S AGREEMENT (this "Developer's Agreement" or this "Agreement") is entered into by and between AVON SENIOR LIVING, LLC, a Michigan Limited Liability Company, hereinafter referred to as "Developer", and the CITY OF AVON, Lorain County, Ohio, hereinafter referred to as "City". "Council" shall refer to the City Council of Avon, Lorain County, Ohio, and "City Engineer" shall refer to the City Engineer of the City of Avon or his designee hired to perform services on this project. The term "Development" shall refer to the installation/construction of public utilities as set forth in the plans and specifications submitted to Planning Commission and contingently approved on July 20, 2016 as part of the Final Development Plan. Said approval became final on December 2, 2016.

THIS DEVELOPER'S AGREEMENT (this "Developer's Agreement" or this "Agreement") is entered into by and between JARONE DEVELOPMENT, LLC, an Ohio limited liability company, hereinafter referred to as "Developer", and the CITY OF AVON, Lorain County, Ohio, hereinafter referred to as "City". "Council" shall refer to the City Council of Avon, Lorain County, Ohio, and "City Engineer" shall refer to the City Engineer of the City of Avon or his designee hired to perform services on this project. THIS DEVELOPER'S AGREEMENT (this "Developer's Agreement" or this "Agreement") is entered into by and between DISCOUNT DRUG MART, an Ohio corporation, hereinafter referred to as "Developer", and the CITY OF AVON, Lorain County, Ohio, hereinafter referred to as "City". "Council" shall refer to the City Council of Avon, Lorain County, Ohio, and "City Engineer" shall refer to the City Engineer of the City of Avon or his designee hired to perform services on this project, in this case Polaris Engineering. The term "Development" shall refer to the construction of Middleton Road, approximately 700 feet east of Nagel Road, as a public road, located on a 0.7585 acre parcel of land. The project shall include pavement for three lanes of traffic, pavement markings, storm sewer, curb and gutter, public water, sanitary sewer, sidewalk and all appurtenances thereto (collectively, the "Public Improvements"). THIS DEVELOPER'S AGREEMENT (this "Developer's Agreement" or this "Agreement") is entered into by and between MENARD, INC., a Wisconsin corporation, hereinafter referred to as "Developer", and the CITY OF AVON, Lorain County, Ohio, hereinafter referred to as "City". "Council" shall refer to the City Council of Avon, Lorain County, Ohio, and "City Engineer" shall refer to the City Engineer of the City of Avon or his designee hired to perform services on this project.
