This Data Processing Addendum, including its Schedules and Exhibits (“Addendum”) completes and forms part of the service distribution agreement between Distributor (as defined below) and Intermedia (as defined below) governing Distributor’s use of the Service (altogether “Distribution Agreement”). This Addendum is concluded between Intermedia.net, Inc. and its affiliates, subsidiaries and branches (collectively, “Intermedia”) and the Distributor that has entered into the Distribution Agreement) (“Distributor”) and is subject to the terms, conditions, restrictions and limitations set forth in the Distribution Agreement.
