(this “Amendment”) is made and entered into as of the day of January, 2021 (the “Effective Date”) and amends that certain Brewer Circle Development Agreement, dated as of September 23, 2019 (the “Initial Agreement”), by and between the Town of Wake Forest, a North Carolina municipal corporation (the “Town”), and DRCW Investments, LLC, a North Carolina limited liability company (the “Developer”). Capitalized terms used and not otherwise defined herein shall have the meaning given to them in the Initial Agreement. The Initial Agreement together with this Amendment shall hereafter be referred to collectively as the “Agreement.”
