This purchase order (“Order”) is placed by Buyer subject to the terms, conditions and instructions appearing on the face and reverse sides of this Order and any attachments hereto, or other documents expressly incorporated herein by reference. Specifications, drawings and data submitted to Supplier with this Order are hereby incorporated and made a part of this Order. By accepting this Order, Supplier agrees to be bound thereby. No additions or modification will be binding upon Buyer unless agreed to in writing by a duly authorized representative of Buyer. Performance by Supplier, in whole or in part, shall be deemed acceptance of these terms.1 Any additional or different terms or conditions contained in any acknowledgment of this Order by Supplier or any other document presented by Supplier shall be deemed objected to by Buyer without need of further notice of objection and shall be of no effect nor in any circumstance binding upon Buyer unless accepted by Buyer in writing.
