THIS PRE-CLOSING OCCUPANCY AGREEMENT (the “Agreement”) is made this day of , 20 , by and between , residing at (the “Seller”); and , residing at (the “Buyer”). Buyer and Seller may each be referred to individually as a “Party” and collectively as the “Parties”. WHEREAS, Seller and Buyer have entered into a Purchase and Sale Contract dated (the “Contract”) for certain property set forth in Paragraphs 1 and 2 of the Contract (the “Property”) providing that the closing was/is to occur on or about , 20 (the “Closing”); and WHEREAS, circumstances have now arisen whereby Buyer wishes to obtain, and Seller has agreed to permit Buyer to have, possession of the Property prior to the Closing upon the terms and conditions hereinafter described.
