This Software License Agreement (the “Agreement”) is a legally binding agreement between you, the end-user, and either (i) if you reside in Canada, MKS Inc.; or (ii) if you reside outside of Canada, MKS Software Inc., as licensor (the applicable licensor being hereinafter referred to as “MKS”). Carefully read the following terms and conditions before installing this MKS software program (the “Software”). By installing, copying or otherwise using the Software, you represent (i) that you have been authorized to accept the terms and conditions of this Agreement on behalf of an organization (in which event “you” and “your” shall refer to such organization), or (ii) that you intend to be personally bound by the terms and conditions of this Agreement.
