This Loan Disbursement Procedures Agreement (this "Agreement") is entered into as of _ 1, 2021, ORIX REAL ESTATE CAPITAL, LLC, a Delaware limited liability company ("HUD Mortgagee"), WICHITA RAD SENIOR, L.P., a Kansas limited partnership ("Borrower"), ZIONS BANCORPORATION, NATIONAL ASSOCIATION, as trustee ("Trustee"), THE CITY OF WICHITA, a municipal corporation of the State of Kansas (the "City") and KANSAS HOUSING RESOURCES CORPORATION ("KHRC", and collectively with City, "Subordinate Lenders"). The HUD Mortgagee, Subordinate Lenders, and Seller may each be referred to individually as a "Lender", or collectively as the "Lenders".
