This Second Amended and Restated Joint Powers Agreement is made this 18th day of July, 2013, by and between the County of Merced, the City of Merced, the City of Los Banos, the City of Atwater, the City of Livingston, the City of Dos Palos, and the City of Gustine. This Agreement supersedes the Transit Services Consolidation Agreement dated January 24, 1995, as modified by Resolution 2002/03/21/2 affirming the separate existence of the Authority, the Amended and Restated Joint Powers Agreement dated November 24, 2009, and the First Amendment thereto dated December 13, 2012. Terms beginning with capital letters are defined in Exhibit A. The County and cities are collectively referred to as the Agencies. The Authority shall continue pursuant to the Act.
