As set forth in the foregoing FCC Form 608, Schley County Board of Education (“Lessor”), and Clearwire Spectrum Holdings III, LLC (“Lessee”) (collectively the “Parties”) are parties to an EBS Long Term De Facto Transfer Lease Agreement (“Agreement”), for the use of Lessor’s Educational Broadband Service (“EBS”) Station WNC945, whereby Lessor will lease the excess capacity over the channels to Lessee, subject to the approval of the Commission.
