The Kenosha Stormwater Utility requires a Stormwater Management Maintenance Agreement be submitted with the proposed development plans for site plan review. A Stormwater Management Maintenance Agreement is to establish long- term, post-construction management of stormwater management practices constructed within the proposed development. The Stormwater Management Maintenance Agreement shall be an agreement in the recordable document format, between the Stormwater Utility and the responsible party(s), organization, or governmental sector to provide for maintenance of stormwater management practices after issuance of an Occupancy Permit. The Stormwater Management Maintenance Agreement shall be recorded with the Kenosha County Register of Deeds as a deed restriction, binding all subsequent owners to the Stormwater Management Maintenance Agreement for the corresponding approved plans.
