WHEREAS, on the , day of , 2005 ACS and Member Pharmacy entered into a Member Pharmacy Agreement (the “Agreement”), pursuant to which ACS engaged the Member Pharmacy as part of its pharmacy network under the terms set forth in the Agreement in order to serve ACS’ customer and its respective Injured Workers’ of the Ohio Bureau of Workers’ Compensation Pharmacy Benefit Program (the “Program”).
