The Agreement aims to establish a development bank in accordance with a decision taken by the Federative Republic of Brazil, the Russian Federation, the Republic of India, the People’s Republic of China and the Republic of South Africa (BRICS) at the Fifth BRICS Summit in Durban, in 2013. The Agreement is comprised of two parts: the first is a short “Inter- governmental Agreement” capturing the high level agreement to establish the New Development Bank (hereinafter “the Bank”); the second agreement, is annexed to the first, contains the provisions under which the Bank will operate.
