This First Amended and Restated Tankage, Loading Rack and Crude Oil Receiving Throughput Agreement (this “Agreement”) is dated as of January 11, 2012 to be effective as of the Effective Time (as defined below), by and between Frontier Refining LLC, a Delaware limited liability company (“Frontier Cheyenne”), and Cheyenne Logistics LLC, a Delaware limited liability company (“Cheyenne Logistics”). Each of Frontier Cheyenne and Cheyenne Logistics are individually referred to herein as a “Party” and collectively as the “Parties.”
