This Confidentiality Agreement dated as of [ ] (this “Agreement”) between WaveCrest Energy, LLC (“WaveCrest”) and [ ] (the “Company”). Each of WaveCrest and the Company are referred to herein individually as a “Party” and collectively as the “Parties”. In its capacity as a Party receiving Confidential Information, as that term is hereinafter defined, a Party may be referred to herein as a “Recipient”; in its capacity as a Party disclosing Confidential Information, a Party may be referred to herein as a “Discloser”.
