THIS AMENDMENT NO. 1 is entered into this day of , 2013, by and between the Department of the Army (hereinafter the “Government”), represented by the U.S. Army Engineer, St. Paul District (hereinafter the “District Engineer”), and the City of Fargo, North Dakota (hereinafter the “City of Fargo”) represented by its Mayor, the City of Moorhead, Minnesota (hereinafter the “City of Moorhead”) represented by its Mayor and City Manager, and the Flood Diversion Board of Authority (hereinafter the “Flood Diversion Board of Authority”) represented by its Chairman (hereinafter collectively the “Non-Federal Sponsors”).
